Governing Requirements - What Residents of Seavue Need to Know
Equality: The state of being equal, especially in status of rights and responsibilities.
Washington State governs condominiums under four separate laws. Seavue is primarily subject to RCW 64.32 (Old Act) as a condominium that was built prior to 1990, however, when the State updates condominium law, they normally update the law under the most current Act, RCW 64.34 (New Act) or just recently the July 2018 Act under RCW 64.90 (Uniform Common Interest Ownership Act). When the legislature passes changes, they make the new law applicable, not applicable, or allow the homeowners to adopt the provision(s). Condos that are governed under RCW 64.32, 64.34, or 64.90. RCW 64.38 applies to planned developments and shared property without housing. However, some items such as budgets, reserves, voting, and transparency issues are covered under 64-90. In January 2028, all shared properties will be covered under 64-90 as amended.
Governing Rules and Regulations are applicable and enforceable by law. Any violation of any of the governing documents, including these Seavue House Rules, shall be subject to the Compliance, Fines and Appeal Policy as adopted by the owners by amendment to the Declaration.

Living in a condominium means owning your apartment and a percentage of the common and limited common area of the building and property. Owners and their renters are legally sharing space with other families and this means compromise.
That is why the State of Washington, and all other states, mandate a set of requirements and make it mandatory the governing documents are adhered to with equality, not necessarily fairness. This is because what is considered all right to do or what is fair to one person may have the same opinion to the next person. Therefore, the law sets out these requirements to ensure equality for all to abide by.

Seavue's Declaration was amended and restated being adopted by 100% of owners in 2018. In addition to RCW 64.32, several amendments from RCW 64.34 have been adopted, and several other laws applicable in RCW 64.34 and RCW 64.90 are applicable. For an overview please review page 50.
